Feds Investigate "Border Patrol" Web Posts

RED CREEK - The U.S. Attorney’s Office and the Department of Homeland Security, at the request of Wayne County District Attorney Richard Healy, are investigating posts on the Wayne County Star’s website that purport to have been made from U.S. Border Patrol/Homeland Security computers. There were three posts showing different Border Patrol/Homeland Security Internet Protocol addresses in response to a story on the Star’s website about a June 12 Border Patrol detention of Mexican nationals on Lake Ontario. One post pretended to be from a woman with a Mexican boyfriend; the other two posts insinuated the boat had come from Cuba, berated farmers, accused them of breaking the law and praised the Border Patrol for doing a good job. The posts, which were made anonymously on June 20 and 21, identified themselves on the public part of the website with fake Internet addresses: Imaapplehog2@yahoo.com, poorbabies@hotmail.com and hahaha@hotmail.com. The Star discovered they all had Internet protocol addresses that showed as originating from cbp.dhs.gov. Dhs.gov is the homepage of the U.S. Department of Homeland Security. The post from the pretend girlfriend, sent by Imaapplehog2@yahoo.com, appeared in response to another post also from a fake email: dirtymex@applelover.com.: “watcha doing to mi wifey, no checky her papeles. she no legal, but she havey benifit card. oh wait, take her and I get me a applehog till I go to Mexico. Viva la Raza!!!” That post originated from a Rochester Roadrunner Internet protocol. The response, which indicated it came from bcp3.cbp.dhs.gov, read, “That sounds like my boyfriend. Leave him alones and get your own. My boyfriend works sometimes but he is really good at getting FREE benefits from the Federal and State government.” On June 18, the day after the story about the Border Patrol boat detention appeared in the Star, the newspaper received a phone call from a U.S. Border Patrol agent in Oswego. The officer wanted to know how to get a copy of the story and the photos that accompanied it. He was told by the paper’s editor he could access it online, but he indicated he had already been on the website, and it was not working. The site came back on line June 20, the day the posts began appearing. After the IP locations were discovered, the newspaper contacted Healy and provided him with copies of the posts. He notified the U.S. Attorney Office in the Western District in Buffalo and asked for a federal investigation. Healy said the matter has been turned over to Richard Ford, the Office of Homeland Security’s Inspector General in the Western District. Healy said he provided copies of the posts to the federal agencies. The Star has found more posts on its website purportedly from a hidden cbp.dhs.gov address on July 14, made by someone who listed their name as Screech. One of those posts challenged the views of Dr. Lorrie Ghertner, owner of Blossomview Nursing Home and a farmworker rights advocate. The name Screech also showed up on other posts relating to the boat raid that were not identified as coming from border patrol computers. Additionally, the Star found hidden cbp.dhs posts dating back to November of 2008 on various and stories. All of the posts were turned over to Ford at his request. Ford indicated to the Star the case must be thoroughly investigated regarding the source of the posts. He would not comment on the investigation for publication. The Department of Homeland Security Policy on Personal Use of Government Office Equipment considers an inappropriate personal use “creating copying or transmitting any material or communication that is illegal or offensive to fellow employees or to the public, such as hate speech, material that ridicules others based on race, creed, religion, sex, disability, national orientation or sexual orientation.” It also warns about proper representation, noting that employees must ensure that personal use does not give the appearance of acting in an official capacity. “For example, DHS employees may not post DHS information to external newsgroups, bulletin boards or other public forums without DHS authorization, “ according to the policy. If the actions of a DHS employee “leaves the impression that his/her personal activities are endorsed by DHS, the employee may be in violation of the Standards of Ethical Conduct for Executive Branch Employees.” Sanctions may result in loss or limitation of employees’ privilege. Employees may also face administrative action ranging from counseling to removal from the Agency, as well as criminal penalties, depending on the severity of the misuse.

Subject: More mediocre reporting...
Once again, a mediocre article attempting to smear the US Border Patrol. The only reason that info was so easily provided to the Feds is that the original author was upset that someone disagreed. Too bad, so sad.
As far as DHS policy being violated, there's nothing that was posted that clearly falls within those guidelines. What offends one person might not offend another.
Well done, Wayne County Star... keep up the substandard level of reporting.

Why isn't the WCStar posting the IP address's of every message posted? Are they only interested in violating the privacy of people they don't agree with? It's strange that no crime or evidence of a crime is mentioned in the story, but "something" caught the attention of the DA. I won't be surprised to hear that the WCStar or their ISP illegaly provided or obtained the IP locations.

There is no denying freedom of speech in what was reported and discovered by the author/editor of this article.
It is, however, not appropriate to use business computers in any business or industry for personal use. This is particularly a problem when the employer has specific policies against denigrating speech.
The act of making statements of opinion should always be acceptable but personal emails from a government computer which displays racial undertones or infantile speech and which clearly is particularly offensive is not acceptable by the standards of the US government.
The editor and I do not frequently see eye to eye but in this case, I must support her making this public.

Article 156 of the New York state penal law regarding offenses involving computers states that a person is guilty of computer trespass when he knowingly uses a computer or computer service with the intent to commit or attempt to commit or further the commission of any felony. Computer trespass is a class e felony, punishable by a minimum of 3 years and a maximum of 4 years in prison.
SO how did the WCS get the IP addresses? I see a Class E Felony coming.
IS the DA Healy involved in this too? What is require to obtain an order to obtain such ips. Is there a criminal investigation going on here? Or is there criminal activity going on here!

Subject: IP addresses are readily available to host servers
An IP address is on the host server, and I would assume that the WCS has their own server. Looking at the origination of an email does not qualify as a computer trespassing violation.
Let's stay on the content, which is we in Wayne County feel that our farm workers and other workers are unfairly persecuted and followed by the local US Border Patrol Agents. I say local, because I would think every US Border Patrol section has its own mandates and directives to pursue. Who is giving the upstate NY Border Patrol stations these directives is my concern.

In PHP (one of the most popular computer languages) its a simple $_SERVER['REMOTE_ADDR'] variable - see http://us2.php.net/manual/en/reserved.variables.php . It is routinely logged for all communication. No warrent, court order, hacking necessary.

Newspapers have a duty to follow the news where it may lead. This duty has benefited the nation many times. As a result, journalists get attacked from all sides on a regular basis.
The important thing is for them to continue to investigate all including the powerful as well as the powerless, private citizens as well as public employees. Their responsibility is to more than one state's or country's laws, but to universal human rights. When we lose this fourth check and balance to unbridled power, we all suffer, because in that role newspapers serve as a buffer against violations to our freedom.
The publisher and reporters of the Wayne County Star should be applauded for their work.

It has nothing to do with free speech; it's a violation of privacy. The only information the posters provide is the "name, subject, and comment" fields at the bottom of the story. There is no "terms of use" section of this website, so in it's absence, the fish wrap bird-cage liner of a newspaper's staff should know enough to contact the poster and get their permission to print any more personal information. Why aren't they printing the IP addresses of every post? The Feds could just as easily investigate every post that indicates support for harboring and hiring illegal aliens. Those are crimes, while nothing in this story, reported to the DA, indicates evidence or the commission of a crime.

Illegal immigration is an issue that should be dealt with, unfortunately the only solution we seem to hear is deportation of the laborers who voluntarily travel to the farms and work for low wages and replacing them with citizens. Funny thing is those who propose this solution have no intention of working on the farm for low wages, they always expect it will be someone else.
And for those who are getting excited about the IP addresses being illegally obtained, your ignorance suggests that perhaps you are a good candidate to work on a farm picking apples for a meager wage.
The Internet Protocol does not work like the ancient telephone system where you can make harassing crank calls in anonymity unless a warrant is issued to trace the call. Every time you access a web page and send a web form you give out your IP address. Without the IP address the routers that direct the traffic on the internet will not know where to send the requested web page.
If these DHS employees had sent the comments from their own personal internet connection, i.e. a Road Runner cable connection, then the IP address would only show it came from a Road Runner account but not which account.
However, in this case the comments were sent from a DHS computer that was using an IP address assigned specifically to DHS, not Road Runner. Just because individuals are behind a semi-anonymous ISP provided IP address doesn't mean everyone is. Businesses and government divisions usually have their own block of IP addresses that can be identified with a simple reverse DNS lookup which commonly is performed by the web server as it records usage statistics.
While you can debate the ethics of handing over this information there was nothing illegal about it.

The Wayne County Star didn't like the comments posted at the end of a story about the Border Patrol. So it investigated the IP addresses of the commenters, and when it discovered that some comments came from Border Patrol addresses, it removed the comments and called in the prosecutors and the inspector general, who are now investigating the commenters.
For some reason, this reminds me a bit of the Gates-Crowley controversy: I can't help suspecting that the Wayne County Star is so enamored of its first amendment status as presumed victim of government oppression that it sees government oppression everywhere and doesn't see anything odd or ironic about bringing down the full weight of government on one or two blue-collar (well, green collar) workers in the Border Patrol because of, well, what they said.

Ama dingus, I was not the one that brought up free speech. Ersparck claimed what happened was a free speech violation. When clearly it was not violation of his free speech.
As far as privacy goes, you entered a public forum when you posted here. I suspect this newspaper probably did look at every posters IP address. Ama dingus, could you site the statute that the newspaper violated by exposing where some of the posts came from.
I have to admit it does look like a government agency might have been attempting to sway public opinion here. Perhaps we should know whether this was the policy of the agency or just some individuals posting comments. If it is individuals I would suggest they should voice their opinions from their home computer rather than the office computer.

Freedom of Speech doesn't apply on a public forum owned by an entity such as WCS or even yourself. If I went on your forum and you wanted to ban me for swearing, then I can't force you to let me back on, because the forum is your property. If you were to come on my forum and say a lot of bad things, I have a right to look at my logs and if you're bothering me I can just tell the owner of the IP that you're using their connection to bother me for example. That is what WCS did, they notified the owner of the IP that their employees are engaged in activities which are clearly frowned upon by any business or organization.

Problem is if I or someoen els posted a threat on a forum or to a government official, agency how long would it take for the feds to come looking for me and arrest/taser me for making threating or rasist comments.
